The Foreclosure Timeline in Illinois is shown above. This may vary depending on your circumstances and may often take longer. Illinois is a judicial state.

1.) Once you default or stop making payments on your loan, the lender will typically file an NOD “Notice of Default” or Lis Pendens. You will be personally served a summons and have 30 days to answer.

2.) After filing the NOD, the clock starts ticking. In Illinois the statutory foreclosure process takes 7 months for a foreclosure judgement and subsequent auction of your home.

3.) During the reinstatement period, you have the right to pay all past due amounts, penalties, lender attorney costs, etc. and stop the foreclosure.

4.) During the redemption period, you have the right to pay back the entire loan plus fees and can stop the foreclosure. You can do this by refinancing or selling your property.

5.) After the redemption period, comes the auction, where your property will be sold to the highest bidder. In the event that your property doesn’t sell to a third party, the lender in first lien position will then become the new owner.

6.) After the auction, the court will do their due diligence (to ensure you have not done anything to cure the default) and issue a confirmation of sale. If you have not vacated the premises by then, the sheriff can evict you.
